Terms & Conditions Miami Content Strategy for realtors and personal photo & video

Welcome to imotion. These Terms and Conditions govern your use of our website and the purchase of our professional services. By engaging with us, you agree to be bound by the following terms.

1. Professional Services

The Company provides high-end visual production and business strategy services, including but not limited to the Elite, Premium, Luxury, and Smart tiers. Each service is subject to the specific deliverables outlined in your individual service agreement or invoice.

2. Payments and Billing

• Service Fees: All prices are listed in USD. Payments are due in full or as per the agreed-upon installment plan before the commencement of services.

• Memberships: The Premium: Always Perfect Coverage requires a minimum commitment of three (3) months. Recurring payments will be processed monthly.

• Signature Sessions: Must be paid in full at the time of booking to secure your date.

 

3. Scheduling and Cancellations

• Production Dates: Scheduling is subject to availability in the South Florida area.

• Rescheduling: We require at least 48 hours' notice for any rescheduling. Failure to provide notice may result in a rescheduling fee or the forfeiture of that session.

• Refunds: Due to the customized nature of our strategic and creative work, all payments are non-refundable once the service or strategy phase has commenced.

 

4. Intellectual Property

• Work Product: Upon final payment, the client is granted a non-exclusive, perpetual license to use the delivered photos and videos for their personal and business branding across digital platforms.

• Ownership: The Company retains the moral and legal ownership of the raw footage and creative assets and may use the final content for its own promotional and portfolio purposes unless a Non-Disclosure Agreement (NDA) is signed.

 

5. Client Responsibilities

Clients are responsible for their own preparation, punctuality, and cooperation during production sessions. The quality of the final product is a collaborative effort; the Company is not responsible for suboptimal results due to lack of client preparation or branding alignment.

6. Delivery Timelines

Standard delivery for edited content (Reels, Photography, etc.) is 5 to 7 business days from the date of the session or final selection. Complex productions may require extended timelines, which will be communicated in writing.

7. Limitation of Liability

Human Integrated Operational Systems LLC shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services or the performance of the content provided.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Miami-Dade County.
